Confidentiality and Non-Disclosure Agreement

As part of the Confidentiality and Non-Disclosure Agreement (NDA) that prospective Operators have executed with iGaming Ontario, iGaming Ontario would like to remind Representatives of prospective Operators of their obligations under the NDA that prospective Operators have executed with iGaming Ontario.

As part of the NDA, you agree to use any and all Confidential Information belonging to iGaming Ontario solely for the purpose of discussing elements of a potential agreement to be entered into between iGaming Ontario and registered operators to enable the operators’ participation in the iGaming Market conducted and managed by iGaming Ontario and to not disclose this Confidential Information other than to your affiliates and your employees, officers, directors, shareholders, service providers, lawyers, accountants and financial advisors ("Representatives") who:

1. need access to such information for the Purpose;
2. are informed of its confidential nature; and
3. are bound by confidentiality obligations no less protective of the Confidential Information than the terms contained herein.

For clarity, unless otherwise stated, Confidential Information includes, but is not limited to, emails sent from igoconnect@igamingontario.ca and information posted on the iGOConnect portal.

Failure to abide by the terms of the NDA may result in iGaming Ontario terminating the NDA and removal of your access to the iGOConnect portal in addition to any further remedies available to iGaming Ontario under contract, at equity or at common law.
